Declaring Access to Brazilian Genetic Heritage

As an inventor seeking patent protection for my toothpaste formula based on the wild grown Ziziphus Joazeiro and traditional knowledge, I encountered unique challenges in accessing the Brazilian genetic heritage. The Brazilian government has established the SisGen platform to ensure compliance with the country's legal framework on access to genetic resources and associated traditional knowledge. In this blog post, I will discuss the difficulties I faced in declaring access to Brazilian genetic heritage through the SisGen platform and the importance of incorporating traditional knowledge in my patent application.

  1. Brazil is renowned for its rich biodiversity, making it a valuable source of genetic resources. To protect these resources and the traditional knowledge associated with them, Brazil has implemented Access and Benefit-Sharing (ABS) regulations. These regulations aim to ensure fair and equitable sharing of benefits derived from the utilization of genetic resources and traditional knowledge. Compliance with these regulations is crucial when accessing and commercializing natural ingredients like wild grown Ziziphus Joazeiro.

  2. The Brazilian government established the SisGen platform as a centralized system for individuals and organizations to declare their access to genetic heritage. The platform facilitates the registration of genetic resources and associated traditional knowledge, ensuring transparency and accountability. Registering on SisGen is mandatory for inventors, researchers, and companies that utilize Brazilian genetic resources, including those derived from wild grown Ziziphus Joazeiro.

  3. While the SisGen platform aims to streamline the declaration process, navigating its requirements can be challenging. One difficulty I encountered was the need to gather and document detailed information about the access, including the location, purpose, and duration of the collection. Additionally, declaring the usage of traditional knowledge associated with Ziziphus Joazeiro required collaboration with indigenous communities or traditional practitioners to ensure accurate representation and fair recognition of their contributions.

Collaborating with Indigenous Communities and Traditional Practitioners: Incorporating traditional knowledge associated with Ziziphus Joazeiro into my patent application was crucial not only for legal compliance but also to acknowledge the contributions of indigenous communities and traditional practitioners. Engaging in respectful and meaningful dialogue with these stakeholders ensured that their knowledge and expertise were appropriately represented. Collaborative efforts allowed me to gain insights into the sustainable use of Ziziphus Joazeiro and fostered relationships built on trust and mutual respect.

  5. Installing necessary certificates and encrypting software to access SisGen is a real challenge. They changed certificate provider without updating the instructions. I needed to work with support and installing encryption software from another provider.


Declaring access to Brazilian genetic heritage, particularly when utilizing wild grown Ziziphus Joazeiro and incorporating traditional knowledge, presents unique challenges. Compliance with ABS regulations and registration on the SisGen platform are vital steps to protect biodiversity, respect traditional knowledge, and facilitate fair benefit-sharing. Engaging in open dialogue with indigenous communities and traditional practitioners is essential to recognize their contributions and foster sustainable collaborations.
